Error driving on the sidewalk

Pursuant to Point d, Clause 5; Point b, Clause 11, Article 5, Decree No. 100/2019/ND-CP amended by Point c, Point d, Clause 34, Article 2, Decree No. 123/2021/ND-CP stipulating the level of penalties for drivers of cars and similar vehicles violating road traffic rules:

Article 5. Penalties for drivers of automobiles and similar vehicles violating road traffic rules

5. A fine of VND 4,000,000 to VND 6,000,000 shall be imposed on a driver who commits one of the following violations:

...

d) Driving a vehicle not on the right side of the road in the direction of travel; driving in the wrong part of the road or lane (lane in the same direction or lane in the opposite direction) except for the acts specified in Point c, Clause 4 of this Article; driving a vehicle across the fixed median strip between two lanes of traffic; driving a vehicle on the sidewalk, except for the case of driving a vehicle across the sidewalk to enter a house;

11. In addition to being fined, the driver who commits the violation shall also be subject to the following additional penalties:

b) Committing the acts specified in Point d, Clause 2; Point h, Point i, Clause 3; Clause 4; Point a, Point b, Point d, Point dd, Point g, Point i, Clause 5 of this Article shall have the right to use a driving license revoked from 01 month to 03 months;

Mistake of riding motorbike on sidewalk

Pursuant to Point g, Clause 3, Article 6, Decree No. 100/2019/ND-CP amended and supplemented by Point b, Clause 4, Article 2, Decree No. 123/2021/ND-CP stipulating the level of penalties for drivers of motorbikes, mopeds (including electric motorbikes), vehicles similar to motorbikes and vehicles similar to motorbikes violating road traffic rules:

Article 6. Penalties for drivers of motorbikes, mopeds (including electric motorbikes), vehicles similar to motorbikes and vehicles similar to motorbikes violating road traffic rules

3. A fine of VND 400,000 to VND 600,000 shall be imposed on a driver who commits one of the following violations:

g) Driving a vehicle that does not keep to the right in the direction of travel; driving in the wrong part of the road or lane (lane in the same direction or lane in the opposite direction); driving a vehicle across the fixed median strip between two lanes of traffic; driving a vehicle on the sidewalk, except for driving a vehicle across the sidewalk to enter a house;

Thus, motorcyclists riding on the sidewalk will be fined from 400,000 VND to 600,000 VND. However, motorcyclists riding on the sidewalk to enter a house will not be fined.

Prohibited acts in road traffic

Pursuant to Article 8 of the 2008 Road Traffic Law, amended by Clause 1, Article 35 of the 2019 Law on Prevention and Control of Harmful Effects of Alcohol and Beer, the following acts are prohibited in road traffic:

- Destroying roads, bridges, tunnels, ferry terminals, traffic lights, markers, signs, convex mirrors, median strips, drainage systems and other works and equipment belonging to the road traffic infrastructure.

- Illegal digging, drilling, and cutting of roads;

- Place or leave illegal obstacles on the road;

- Place, spread sharp objects, pour slippery substances on the road

- Illegally dumping materials, waste, and litter on the street;

- Opening roads and illegal connections to main roads;

- Encroachment, occupation or illegal use of road land and road safety corridors;

- Arbitrarily opening manhole covers, dismantling, illegally moving or distorting road works.

- Illegal use of roads, sidewalks, and pavements.

- Using motor vehicles and specialized motorbikes that do not meet technical safety and environmental protection standards on road traffic.

- Changing the vehicle's assemblies, components, and accessories to temporarily meet the vehicle's technical standards when undergoing inspection.

- Racing, cheering on racing, organizing illegal racing, weaving, and swerving.

- Driving a road vehicle while having drugs in the body.

- Driving a vehicle on the road while having alcohol concentration in the blood or breath.

- Driving a motor vehicle without a driver's license as prescribed.

- Driving a specialized motorbike on the road without a certificate of training in road traffic law, a license or certificate to drive a specialized motorbike.

- Handing over motor vehicles and specialized motorbikes to people who are not qualified to drive vehicles on the road.

- Driving a motor vehicle at a speed exceeding the prescribed speed limit, competing for the road, or recklessly overtaking.

- Honking and revving the engine continuously; honking from 10pm to 5am, honking the air horn, using high beams in urban areas and densely populated areas, except for priority vehicles on duty as prescribed by this Law.

- Installing and using horns and lights not in accordance with the manufacturer's design for each type of motor vehicle; using audio equipment that disrupts traffic safety and public order.

- Transporting prohibited goods, illegally transporting or not fully complying with regulations on transporting dangerous goods and wild animals.

- Threaten, insult, fight, or entice passengers;

- Forcing passengers to use services against their will;

- Transferring, unloading passengers or other acts to avoid detection of overloaded vehicles or vehicles carrying more people than the prescribed number.

- Transport business by car without meeting the business conditions as prescribed.

- Fleeing after causing an accident to avoid responsibility.

- When having the conditions but intentionally not helping people in traffic accidents.

- Infringement of life, health and property of victims and accident perpetrators.

- Taking advantage of traffic accidents to assault, threaten, incite, pressure, disrupt order, or obstruct the handling of traffic accidents.

- Taking advantage of one's own position, power, or profession or that of others to violate road traffic laws.

- Illegally manufacturing, using or buying and selling license plates of motor vehicles and specialized motorbikes.

- Violations of road traffic rules and other acts that endanger people and vehicles participating in road traffic.
