Binh Giang strives to eliminate violations of irrigation works

Clear multiple violations

Implementing the province's direction on resolutely and thoroughly handling violations of irrigation works, Binh Giang district has thoroughly grasped the purpose, objectives, contents and progress of implementation, clearly assigned responsibilities to specialized agencies, socio-political organizations and People's Committees of communes and towns during the implementation process. All 16 communes and towns in the district have issued plans to disseminate and popularize laws on management, and determined a roadmap for handling violations of irrigation works in the area.

Comrade Nguyen Van Dat, Chairman of Hong Khe Commune People's Committee, said: "The Commune People's Committee has established an interdisciplinary inspection team to review, evaluate, and classify violations of the irrigation works corridor. Through the inspection and review process, there are 10 households that have violated the regulations and must be cleared. These households mainly built surrounding walls and temporary shelters in violation of the irrigation corridor managed by the Binh Giang District Irrigation Works Exploitation Enterprise". Hong Khe Commune has actively promoted and mobilized households to dismantle the violating works. As a result, all households voluntarily dismantled and restored the original state.

To effectively handle violations of irrigation works, the People's Committee of Co Bi commune has established a working group, assigning specific tasks with the motto "5 clear": clear people, clear work, clear progress, clear results, clear responsibilities. Based on the results of inspection, review, and assessment of the level of violations, the working groups conduct propaganda, mobilize organizations and individuals who violate to self-handle, clear violations, commit to implementation time...

According to Mr. Nguyen Manh Tuyen, Vice Chairman of Co Bi Commune People's Committee, from the beginning of the year to the end of September 2024, more than 10 households in the commune voluntarily dismantled violations of irrigation works.

From the beginning of the year to October 4, the entire Binh Giang district has handled and cleared 228 violations. The entire district still has 349 violations of irrigation works, of which 256 violations occurred before the Law on Irrigation took effect (before July 1, 2018) and 93 violations occurred after the Law on Irrigation took effect.

Regarding the handling direction, for the 256 violations that occurred before the Law on Water Resources took effect, there were 236 cases that were proposed to continue to be used according to Article 48 of the Law on Water Resources, and 20 cases that were proposed to be cleared. With a total of 113 violations that must be cleared, Binh Giang district will coordinate with Bac Hung Hai Irrigation Works Exploitation One Member Co., Ltd. to continue to develop a handling plan, striving to complete the clearance before December 31, 2024.

Few new violations

With strict inspection and supervision, and coordination between the management unit and local authorities, many emerging violations were promptly detected and prevented. Specifically, in early May 2024, during an inspection on the right bank of Kim Son canal, Bac Hung Hai Irrigation Works Exploitation One Member Co., Ltd. discovered that Mr. Nguyen Duy Hung's household in Zone 4, Ke Sat town had built a solid house on the foundation of an old construction. Bac Hung Hai Irrigation Works Exploitation One Member Co., Ltd. coordinated with Ke Sat town People's Committee to invite Mr. Hung to work. Mr. Hung said that his family had a stable house for more than 20 years. Due to the deterioration of the house, the family wanted to upgrade and repair it. However, according to the Law on Irrigation, after 2018, for old violations, the status quo must be maintained. When the construction deteriorates, it is only allowed to repair it according to the old status quo, and it is not allowed to build a solid house. Therefore, Mr. Hung's family was forced to remove all the corrugated iron sheets behind to restore the original condition.

According to the Binh Giang District Irrigation Works Exploitation Enterprise, from January to September 2024, there were no violations in the irrigation system exploited and managed by the enterprise. Mr. Do Phuong Duy, Deputy Director of the Binh Giang District Irrigation Works Exploitation Enterprise, said: “In September, the enterprise had to focus on overcoming the consequences of storm No. 3, so the plan to handle and clear violations of irrigation works was more or less affected. In the coming time, the enterprise will resolutely handle violations that must be handled and cleared; continue to inspect and promptly coordinate to prevent violations from arising.”

In the coming time, the People's Committee of Binh Giang district will continue to direct specialized agencies and People's Committees of communes and towns to propagate and mobilize organizations and individuals to strictly comply with the provisions of the Law on Irrigation; resolutely handle subjects with violating works that do not voluntarily clear them...
