Prosecution of former Bac Ninh Provincial Party Secretary Nguyen Nhan Chien in the AIC company case

Former Secretary of Bac Ninh Provincial Party Committee Nguyen Nhan Chien was prosecuted for 17 times receiving bribes of 14 billion VND and thank-you gifts.

On September 13, the Supreme People's Procuracy issued an indictment against former Secretary of the Bac Ninh Provincial Party Committee Nguyen Nhan Chien and former Chairman of the Bac Ninh Provincial People's Committee Nguyen Tu Quynh, along with 11 other defendants, for accepting bribes, giving bribes, abusing positions and powers while performing official duties, and violating bidding.

Among them, former Secretary of the Bac Ninh Provincial Party Committee Nguyen Nhan Chien was prosecuted for the crime of “Accepting bribes”. Also prosecuted for this crime are: Nguyen Tu Quynh, former Chairman of the Provincial People’s Committee; Nguyen Hanh Chung, former Vice Chairman of the Provincial People’s Council; Tran Van Tuynh, former Director of the Bac Ninh Provincial Medical Construction Project Management Board.

Former Vice Chairman of the People’s Committee of Bac Ninh Province Nguyen Tien Nhuong was prosecuted for “Abusing position and power while performing official duties”. In addition, seven others were prosecuted for “Violating bidding regulations causing serious consequences”.

Chairwoman of the Board of Directors of AIC Company Nguyen Thi Thanh Nhan was prosecuted for the crime of “Giving bribes”. Currently, Nguyen Thi Thanh Nhan is on the run and is also a defendant being tried in absentia in other cases related to bidding violations with a total sentence of 30 years in prison.

According to the indictment, Mr. Nguyen Nhan Chien was Chairman of the People's Committee of Bac Ninh province from 2011 to 2015, and Secretary of the Provincial Party Committee from 2015 to 2020. Around mid-2013, before implementing 6 medical equipment procurement packages in Bac Ninh, Mr. Nguyen Hanh Chung, Mr. Tran Van Tuynh and Mr. La Tuan Hung (General Director of Song Hong Corporation) met with Mr. Nguyen Nhan Chien. At the meeting, Hung asked Mr. Chien to support the province in requesting additional government bond capital to continue implementing unfinished projects, including 6 district-level general hospital projects.

At the same time, Nguyen Thi Thanh Nhan also contacted with similar content. The leaders of Bac Ninh province in the case agreed that Song Hong Company would carry out 3 packages at hospitals in Yen Phong, Tien Du, Que Vo districts (districts north of Duong River), and AIC Company would carry out 3 packages in Gia Binh, Thuan Thanh, Luong Tai (south of Duong River), causing a loss of 48 billion VND to the budget.

Knowing that Ms. Nhan had connections with the leaders of Bac Ninh province and the Central Government, Mr. Tuynh reported this to Mr. Son. The two sides then agreed that "to avoid conflicts", Song Hong Company would carry out 3 packages at hospitals in Yen Phong, Tien Du, and Que Vo districts, while AIC Company would carry out 3 packages in Gia Binh, Thuan Thanh, and Luong Tai.

According to the investigation conclusion, the defendants violated bidding regulations, used "blue teams" to bid, raised prices... Up to now, all 6 bidding packages have been handed over and caused a loss of 48 billion VND to the budget.

With help in the project, the leaders of Song Hong Company, Mr. Dang Tien Phong and the defendant Le Tuan Hung, gave Tran Van Tuynh a bribe of 6 billion VND. The defendant Tuynh gave each Secretary Nguyen Nhan Chien and Chairman Nguyen Tu Quynh 1 billion VND; and gave gifts to Vice Chairman Nguyen Tien Nhuong many times, totaling 300 million VND.

In addition, defendant Nguyen Thi Thanh Nhan also gave bribes to the above leaders. Defendant Nguyen Nhan Chien stated that from 2014 until his retirement in 2020, he received gifts from this woman on holidays. In total, defendant Nhan went to the office of former Bac Ninh Secretary Nguyen Nhan Chien at the headquarters of the Bac Ninh Provincial People's Committee and Party Committee 13 times, each time giving from 500 million VND to 3 billion VND; a total of 13 billion VND.

Similarly, defendant Nguyen Tu Quynh, in his role as Vice Chairman of the Provincial People's Committee, then Chairman of the Bac Ninh Provincial People's Committee, also received bribes from Nguyen Thi Thanh Nhan and Song Hong Company many times, totaling 8.1 billion VND. Defendant Quynh stated that he spent all of this money for personal use.

During the investigation, both Mr. Chien and Mr. Quynh returned all the money they had received to remedy the consequences.

In this case, Nguyen Thi Thanh Nhan and Nguyen Hong Son (Former Deputy General Director of AIC) are on the run. Both are wanted by the Ministry of Public Security's Investigation Police Agency. Of these, Nguyen Thi Thanh Nhan is wanted nationally, internationally and especially.
