Particularly arduous, toxic, and dangerous occupations may be eligible for early retirement benefits without a reduction in pension.
A male doctor (born in 1967) has paid compulsory social insurance for 28 years and 3 months, of which 17 years and 8 months were spent directly examining and treating AIDS patients. He wants to know if he is eligible for early retirement and will have his pension reduced by 2% each year before his retirement age.
Responding to the above employee, Vietnam Social Security said that according to the provisions of Article 169 of the 2019 Labor Code: Employees who ensure the conditions on social insurance payment period according to the provisions of the law on social insurance are entitled to receive pension when reaching retirement age.
The retirement age of employees in normal working conditions is adjusted according to the roadmap until reaching 62 years old for male employees in 2028 and 60 years old for female employees in 2035.
From 2021, the retirement age of employees in normal working conditions is 60 years and 3 months for male employees and 55 years and 4 months for female employees; then, each year it increases by 3 months for male employees and 4 months for female employees.
Employees with reduced working capacity; working in particularly arduous, toxic, or dangerous occupations or jobs; working in areas with particularly difficult socio-economic conditions may retire at a lower age, but not more than 5 years older than the age prescribed in Clause 2 of this Article at the time of retirement, except in cases where the law provides otherwise.
According to Clause 1, Article 54 of the 2014 Law on Social Insurance, amended and supplemented in Clause 1, Article 219 of the 2019 Labor Code, it clearly states:
Be of legal age as prescribed in Clause 3, Article 169 of the Labor Code and have at least 15 years of experience in a arduous, toxic, dangerous or especially arduous, toxic, dangerous job or occupation on the list issued by the Ministry of Labor, War Invalids and Social Affairs or have at least 15 years of experience in an area with particularly difficult socio-economic conditions, including time spent working in an area with a regional allowance coefficient of 0.7 or higher before January 1, 2021.
Thus, this doctor's job of examining and treating AIDS patients is listed as especially arduous, toxic, and dangerous.
Based on the above information, this doctor is eligible for retirement age. In this case, the doctor can contact the Social Insurance agency where he resides and request a pension settlement without the pension percentage being deducted for each year before the age (2% per year).
Thus, when he retires, this male doctor will still receive 75% of the salary used as the basis for social insurance contributions.
