People's Courts at 2 levels in Hai Duong strive to resolve civil cases

Thanks to specific solutions, the People's Courts at two levels in Hai Duong province have resolved a large number of civil cases, ensuring the legitimate rights and interests of organizations and citizens.

Number of cases and work increased

Ms. Vu Thi Yen, Chief Justice of the Civil Court (Provincial People's Court) said that the number of civil cases in the province is increasing. Many civil cases at first instance that the Provincial People's Court accepts are complicated in nature, such as having foreign elements, many parties from different provinces and cities, intertwined disputes, large value of disputed assets, etc. The Provincial People's Court also accepts and resolves civil cases at appeal level transferred by the District People's Court.

Hai Duong City People's Court is the district court that handled the most civil cases in 2024. The unit handled 208 civil cases (accounting for 21.2% of the total number of district-level civil cases), of which 171 cases were resolved, accounting for 82.2%.

Judge Pham Thi Khanh Thien, Deputy Chief Justice of Hai Duong City People's Court, said that with Hai Duong City being the center of the province, along with civil cases, Hai Duong City People's Court also handles many other types of cases. While the unit only has 12 judges and 13 clerks, it faces many difficulties in ensuring the progress of case settlement.

"In resolving civil cases, although the plaintiff resides and works in Hai Duong City, the people with related obligations are in many places inside and outside the province. Many cases are complicated in nature, making the verification and clarification process difficult and time-consuming," Judge Thien shared.

On November 24, 2023, Kim Thanh District People's Court heard the case of declaring a will invalid and dividing inheritance. Despite the complicated nature of the case with many parties involved, the unit still ensured a quick trial. According to Judge, Presiding Judge Mac Duy Phu, Deputy Chief Justice of Kim Thanh District People's Court, to resolve this case, he had to travel more than 20 times in and out of the province to verify and work with 12 people, including the plaintiff, defendant and related people...

“Many cases are very complicated, and collecting evidence takes a lot of time. Some parties do not cooperate, are summoned but do not come to court, so the judge must directly coordinate with the local authorities where they live and work to resolve the matter,” Judge Phu shared.

Timely handling and removal

Right from the beginning of the 2024 working year, the Provincial People's Court has proposed solutions, focusing on reviewing the number of outstanding civil cases of each judge and each unit; launching a movement to compete in resolving outstanding civil cases.

During the implementation process, the provincial court sector organized preliminary and final reviews, drew lessons learned, and promptly commended and rewarded judges who resolved cases effectively and with quality.

The leaders of the Provincial People's Court also requested to strengthen inspection and examination of civil case files to listen to reports and explanations for each case. After that, there will be a conclusion requesting a time limit to completely resolve each specific case. Judges who let cases exceed the statutory time limit due to subjective errors or temporary suspensions without legal basis will be required to review, handle responsibilities, and evaluate their performance.

In 2024, Thanh Ha District People's Court is the only district-level court in the province to resolve civil cases at a rate of 100%. Judge Nguyen Thi Hang, Deputy Chief Justice of Thanh Ha District People's Court, said: "The unit's leaders always grasp the number of civil cases handled by each judge to promptly provide direction. For complicated cases, the unit organizes meetings with judges to discuss and give suggestions on how to handle them, or report to superiors to discuss professional matters."

Mr. Nguyen Hai Bang, Deputy Chief Justice of the Provincial People's Court, said that in the coming time, the People's Courts at two levels in the province will be determined to completely resolve a number of pending civil cases and temporarily suspended cases. Do a good job of professional training for the team of judges and people's assessors to increase the rate of case resolution and ensure the quality of trials. Regularly organize experience-sharing sessions, online sessions; conduct mobile trials of a number of cases of interest to the people...

The People's Courts at two levels will also continue to closely coordinate with prosecution agencies, specialized agencies and local authorities at all levels to promptly resolve cases according to regulations.

According to the Provincial People's Court, in the working year 2024 (from October 1, 2023 to September 30, 2024), the two-level People's Courts in the province accepted 1,281 civil cases, of which 1,115 cases were resolved (reaching a rate of 87%).
The above results increased by 168 cases and matters accepted; 199 cases and matters resolved compared to 2023; increased by 415 cases and matters accepted, 473 cases and matters resolved compared to 2022.

2024 is the year with the highest civil case settlement rate ever. The Provincial People's Court is the unit with the leading number of cases and rate of civil case settlement in emulation cluster No. IV of the court sector.
