The lawsuit involves alleged misuse of the medical records of 1.6 million people that a British hospital provided to the US tech giant.
In 2015, the Royal Free London NHS Trust – part of the UK’s National Health Service (NHS) – passed on patients’ medical records to Google’s artificial intelligence company DeepMind Technologies, in connection with the development of a mobile app aimed at analysing patient records and detecting acute kidney injury early. In 2017, the UK’s data protection watchdog, the Information Commissioner’s Office (ICO), found that the Royal Free had misused patients’ personal information by passing it on to DeepMind Technologies.
By 2022, patient Andrew Prismall had filed a lawsuit against Google and DeepMind on behalf of 1.6 million patients over alleged misuse of personal information. In March, the two companies argued that there was no basis to claim that the personal information of these 1.6 million people had been misused, or that they had previously requested that this information be kept confidential.
In the latest ruling, Judge Heather Williams dismissed the case, concluding that the plaintiffs had no factual basis for claiming privacy over their medical records.
