High consensus on changing the name to Law on Identification and Identification Cards

On the morning of November 15, the National Assembly Standing Committee gave its opinion on the draft Law on Identification. The majority of National Assembly deputies agreed that renaming the Law on Identification and the ID card is appropriate.

In line with the trend of digital social management

Reporting on a number of major issues related to the draft law, Chairman of the National Defense and Security Committee Le Tan Toi said that regarding the name of the draft law and the name of the ID card, there were opinions that there have been many changes in the form, content and name of the ID card recently, so it is recommended to consider the name of the law; it is recommended not to change the name of the law and the name of the card to ID card.

The Standing Committee of the National Defense and Security Committee believes that changing the form, content, and name of the ID card is in line with the trend of digital society management, with the content being supplemented to be comprehensive, comprehensive, and full of information in the ID card and the form and method of digital management being scientific and popular.

According to the explanation of the examining agency, the current citizen identification card only stipulates the issuance of citizen identification cards to Vietnamese citizens aged 14 and over. The draft Law submitted by the Government supplements the subjects of application to citizens under 14 years old and people of Vietnamese origin whose nationality has not been determined and who are living in Vietnam (people of Vietnamese origin); for people of Vietnamese origin, no identity card is issued but only an identity certificate is issued.

Therefore, the renaming of the law and the card as proposed by the Government is necessary, in accordance with the scope and to cover all the subjects of the draft law. The National Defense and Security Committee believes that the addition, adjustment and issuance of identity certificates to subjects of Vietnamese origin whose nationality has not been determined and who are living in Vietnam is to facilitate the enjoyment of basic human rights for people of Vietnamese origin. In reality, due to the lack of identity papers, they have great difficulty in traveling, transacting, working, owning property, etc., so it is necessary to issue identity certificates to them.

From the above issues, the National Defense and Security Committee finds that the name adjustment to the Law on Identification and Identity Cards is completely appropriate in terms of both the scope and the subjects of the draft Law; achieving the purposes of management and serving the people. Therefore, the National Defense and Security Committee proposes that the National Assembly Standing Committee allow the use of the name Law on Identification and Identity Cards as submitted by the Government.

At the meeting, National Assembly Chairman Vuong Dinh Hue said that the draft law was presented at the 6th Session, most of the National Assembly deputies agreed with the major issues and contributed comments and edited some contents to perfect the draft law.

The National Assembly Chairman also emphasized a number of major contents that have been accepted, explained and highly agreed upon by relevant agencies and organizations. In particular, regarding the collection, updating, management, connection, sharing and exploitation of information in the national population database, adjustments have been made, specifically: State agencies, political organizations, and socio-political organizations are allowed to exploit information in the national population database in accordance with the functions and tasks of those agencies and organizations to avoid abuse and theft of information, as well as to protect the personal information of citizens. Regarding information integration and use of information exploitation, the explaining agency has accepted the opinions of the delegates and justified, supplementing point c, clause 3, Article 5, clause 4, Article 5.

Strengthen propaganda

Regarding the issuance and management of electronic identification cards, there are opinions agreeing on the necessity of regulations on electronic identification cards in the draft Law. There are opinions requesting further reports on the security issue of chip-based identification cards because they are susceptible to intrusion and monitoring.

The Standing Committee of the National Defense and Security Committee said that according to the report of the drafting agency, the current ID card is manufactured using advanced technology, has high security capabilities, and prevents card counterfeiting. The electronic chip on the ID card has authentication technology through fingerprint or face matching to accurately authenticate the cardholder. Accordingly, when a person uses a device to read information stored in the electronic chip, he must have the consent of the cardholder through fingerprint or face authentication methods to be allowed to access and retrieve data.

Opinions at the meeting also suggested that information and propaganda work should be strengthened and fully implemented to create high consensus among the people about the draft Law on Identification.

Speaking at the meeting, Minister of Public Security To Lam said that the drafting agency has closely coordinated with the agencies of the National Assembly to complete the draft law. Based on the opinions of the National Assembly Standing Committee, the drafting agency basically agreed with the directions to complete the draft law. The Minister of Public Security stated that he will continue to closely coordinate with the National Defense and Security Committee to continue to receive, explain, and submit the draft law to the National Assembly for consideration and approval.
