The arrangement of civil servants and officials when merging commune-level administrative units will have a great impact on the political system at the grassroots level because there will be redundancy.

Pre-stage arrangement still has surplus

After nearly 4 years of establishment based on the merger of 3 communes Thanh Binh, Hop Duc, Truong Thanh, Thanh Quang commune (Thanh Ha) is currently a type 2 commune with 6 surplus cadres and civil servants. The current cadre structure of the commune is also not in accordance with current regulations when there are 2 Deputy Secretaries of the Party Committee, 2 Vice Chairmen of the Commune People's Committee. The failure to arrange surplus cadres and civil servants has significantly affected their mentality, especially for cadres who still have a long working time.

“For those who are currently working as chiefs in the old communes and are demoted to deputy level after the merger, if they are not assigned work in a timely manner, it will affect their motivation. The improper structure of the commune leadership also limits the development of the capacity of the cadres, and may even cause difficulties in paying salaries and benefits in the future,” said Mr. Nguyen Van Khoa, Chairman of Thanh Quang Commune People’s Committee.

According to the resolutions of the National Assembly Standing Committee, no later than 5 years from the date of establishment of an administrative unit, the number of leaders, managers and civil servants in the new administrative unit must be ensured according to regulations. Currently, many localities in the province have not yet completed the arrangement of redundant cadres and civil servants after the arrangement of commune-level administrative units in the period of 2019-2021. Typically, Ninh Giang district has 18 cases left. Leaders of some localities are wondering how the redundant cadres and civil servants in the locality will be resolved when the 5-year period expires?

Currently, many places in Hai Duong have temporarily stopped appointing officials and recruiting civil servants at the commune level to reorganize administrative units at the commune level. However, many officials and civil servants believe that along with implementing Decree 29/2023/ND-CP dated June 3, 2023 of the Government regulating staff streamlining, Hai Duong needs to have its own support mechanism, more incentives for those who retire before the age of majority like some provinces of Thanh Hoa, Bac Ninh, Quang Ninh... to create more favorable conditions for arranging and assigning redundant officials and civil servants.

In 2019, Cam Giang town (Cam Giang) was established on the basis of merging Cam Giang town with Kim Giang commune. To meet the requirements of urban development, it is expected that Cam Giang town will continue to merge with Thach Loi commune in the period of 2023-2025 and have a surplus of nearly 20 cadres and civil servants.

Mr. Nguyen Viet Huan, Deputy Head of the Department of Internal Affairs of Cam Giang district, suggested: "Along with having a separate mechanism, creating conditions for redundant cadres, civil servants, public employees, and workers to retire or transfer jobs, the province also needs to issue and guide the early implementation of this policy so that redundant people have the conditions to research and register their wishes. Early implementation will not only facilitate the arrangement of the apparatus and cadres, but also help the information, propaganda, and consensus-building work to be more convincing."

Currently, Hong Phong commune (Thanh Mien) is a locality established on the basis of merging Dien Hong and Tien Phong communes, there are no more redundant civil servants. According to comrade Pham Ngoc Hung, Party Secretary and Chairman of the People's Council of the commune, to quickly resolve this issue, it is necessary for the district level to pay attention to the rotation and transfer of civil servants between communes and towns, including creating conditions for specialized cadres to transfer to civil servants, facilitating the arrangement of cadres.

The establishment of new administrative units on the basis of merging old units will cause changes in the organization and staff. In fact, in many newly established commune-level administrative units, problems often arise from quite complicated internal conflicts. A typical example is Ke Sat town (Binh Giang). After merging Trang Liet commune and Ke Sat town, the locality often received denunciations from the leaders of the old locality as the plaintiffs. The leadership here has continuously changed. Mr. Quach Van Hung, Chairman of the town People's Council (former Chairman of the People's Committee of the old Trang Liet commune) was dismissed, expelled from the Party and then prosecuted for abuse of power while performing official duties in Trang Liet commune.

In March 2022, Mr. Hung was dismissed, but up to now, Ke Sat town has not yet completed the position of Chairman of the Town People's Council, the main reason being the lack of internal solidarity. Last July, the Standing Committee of Binh Giang District Party Committee disciplined the Ke Sat town Party Committee for not completing its leadership and direction tasks; allowing a number of Party Committee members and Party members to not comply with the Party's policies and resolutions, saying and doing did not go hand in hand, leading to the failure to complete the position of Chairman of the Town People's Council for the 2021-2026 term. Along with transferring the Town Party Committee Secretary, the Standing Committee of Binh Giang District Party Committee is also taking steps to transfer the Town People's Committee Chairman to another unit.

Although their terms have not yet ended, in some newly established commune-level administrative units, some key leadership positions have been changed due to problems arising from internal conflicts.

To do a good job of organizing and arranging cadres when arranging commune-level administrative units in the province, according to comrade Trinh Ngoc Thanh, Deputy Director of the Department of Home Affairs of Hai Duong, Party committees at all levels need to focus on evaluating and classifying cadres; impartially and transparently selecting cadres who are truly capable and prestigious to assign tasks and run for leadership positions in new administrative units. "The arrangement of the organizational apparatus and collective leadership of new administrative units needs attention and consideration to build a balanced structure, interwoven between old units. But the most important thing is still to select cadres with qualities and prestige and not necessarily from old localities," Deputy Director of the Department of Home Affairs Trinh Ngoc Thanh emphasized.
