Question: Can you tell me what Hai Duong province's regulations are regarding cases where land plots cannot be divided or merged?

Reply:

On September 12, 2024, the People's Committee of Hai Duong province issued Decision No. 37/2024/QD-UBND stipulating land allocation limits, residential land recognition limits, agricultural land use right transfer limits; conditions for land division and land consolidation; minimum area allowed for land division and land consolidation in Hai Duong province.

According to Article 12 of this regulation, the following cases are not allowed to separate or merge land plots:

1. Cases where land plots cannot be divided

a) Land plots in residential areas and new urban areas have had their detailed construction planning approved by competent authorities in accordance with the provisions of law.

b) Land plots in areas with detailed construction planning approved by competent authorities when implementing land allocation and land use rights auction, including:

- Residential areas, residential areas in urban areas;

- Residential areas and residential areas in rural areas;

- Resettlement residential area.

c) Land plots with land recovery decisions and land recovery notices that are still in effect, except for the cases specified in Point d, Clause 1, Article 151 of Land Law No. 31/2024/QH15.

d) Land plots with all or part of their area located in the planning for construction of public works that have been identified in the annual district-level land use plan approved by a competent authority for land recovery to implement a project that is still in effect.

d) Separating land plots to transfer or donate to residential communities for construction or expansion of religious land areas that are not permitted by law.

e) Separating land plots to transfer or donate to religious organizations or affiliated religious organizations to build or expand religious land areas that are not permitted by law.

2. Cases where land plots cannot be merged include the cases specified in Point a, Point b, Point c, Clause 1 of this Article.”
