Many people participating in traffic often stand on the bridge to enjoy the breeze and wonder if this behavior will be punished?
According to Point c, Clause 4, Article 18 of the Road Traffic Law, drivers are not allowed to stop or park on bridges or under overpasses. Therefore, both stopping and parking on bridges are violations of road traffic regulations, regardless of whether you stop or park to get some fresh air or do something else.
Drivers of cars and similar vehicles stopping or parking on the bridge will be subject to an administrative fine of VND 2,000,000 to VND 3,000,000 and will be subject to additional penalties of having their driver's license revoked for 01 to 03 months as prescribed in Point d, Clause 4, Article 5 of Decree 100/2019/ND-CP, amended and supplemented by Decree 123/2021/ND-CP.
Motorbike and motorbike drivers who stop or park on the bridge will be fined from 400,000 VND to 600,000 VND according to Point d, Clause 3, Article 6, Decree No. 100/2019/ND-CP.
Distinguish clearly between stopping and parking behavior?
According to the 2008 Road Traffic Law, stopping a vehicle is a temporary stationary state of a vehicle for a period of time necessary for people to get on or off the vehicle, load or unload goods or perform other work.
Parking is a stationary state of a vehicle without time limit.
Thus, stopping and parking are two different acts. However, these two acts have the same penalty level so they are often not clearly distinguished from each other.
In addition to prohibiting stopping and parking on bridges, the Road Traffic Law also prohibits drivers from stopping and parking in the following locations:
- Left side of one-way street;
- On curves and near the top of slopes, visibility is obstructed;
- Parallel to another vehicle that is stopped or parked;
- On the pedestrian crossing;
- At intersections and within 5 meters from the edge of the intersection;
- Bus stop;
- In front of the gate and within 5 meters on both sides of the gate of the headquarters of agencies and organizations;
- Where the road section is only wide enough for one lane;
- Within the safety range of the railway;
- Obscuring road signs.
