Proposal to merge the People's Inspectorate with the Community Investment Supervision Board

According to delegate Bui Sy Hoan, Director of the Department of Justice of Hai Duong province, the People's Inspectorate should be merged with the Community Investment Supervision Board to form the Grassroots Supervision Board because there is overlap in the functions and tasks of these two boards.

Delegate Bui Sy Hoan basically agreed with the draft Law on Implementing Democracy at the Grassroots Level and pointed out a number of shortcomings that need further study.

Delegate Bui Sy Hoan expressed his views when talking to reporters of Hai Duong Newspaper on the sidelines of the 3rd Session of the 15th National Assembly about the draft Law on Grassroots Democracy (DCCS). Basically, the delegate agreed with the draft and pointed out some shortcomings that need to be further studied by the drafting committee.

According to the delegate, Clause 2, Article 2 of the draft law stipulates: "Implementing DCCS is a method to promote the people's mastery" while Clauses 1 and 2, Article 2, Clause 1, Article 3... all define the subjects implementing DCCS as citizens, cadres, civil servants, public employees, and workers. In Articles 14-18, the subjects implementing the work of the community are voters or voters representing households.

"Thus, the subject of implementing DCCS is not consistent. It is proposed to use the term "citizen" in general because the word "people" has a very broad meaning depending on each field, but in law it is also similar to the concept of citizen. Meanwhile, the word "citizen" has been stipulated in the 2013 Constitution to include cadres, civil servants, public employees, workers and voters," said delegate Bui Sy Hoan.

Regarding the reasonableness of the provisions in the draft, delegate Bui Sy Hoan said that there are still 3 shortcomings. Article 13 of the draft stipulates the contents for people to discuss and decide and is mandatory. However, Article 14 stipulates the authority to propose the contents for people to discuss and decide. This provision may lead to the understanding that only through procedures, competent agencies and organizations must propose the contents before people can discuss and decide.

Regarding the practice of DCCS in the context of information technology development, delegate Bui Sy Hoan agreed that there should only be general regulations on the use of social networks to publicize information without specifying any specific social networks. In cases where it is necessary for state management, specific instructions can be provided in sub-law documents. In addition, in some localities with fishing villages, where people mainly live on boats, it is very difficult to organize conferences with more than 50% of the total number of voters or voters representing households. The practice of the Covid-19 epidemic in recent years has shown that online conferences and seminars basically meet the requirements. Therefore, it is necessary to collect opinions from specific citizens via social networks or voter meetings, online voting in special cases such as natural disasters, epidemics or in special areas. However, it is necessary to have clear and specific regulations to control and avoid cases of abusing social networks to cause social disorder.

Regarding the provisions of the People's Inspectorate in Chapter V of the draft law, delegate Bui Sy Hoan said that Article 58 stipulates: "The People's Inspectorate has the duty to supervise the implementation of policies and laws..." showing that this committee does not perform any inspection activities but essentially performs the task of supervision. The delegate suggested that it is necessary to determine that the People's Inspectorate is essentially a supervision activity of the people at the grassroots level, thereby including the content of Chapter V in the supervision section in Chapters II, III, and IV accordingly.
