Deputy Prime Minister Tran Hong Ha assigned the Ministry of Planning and Investment to coordinate with the Ministry of Natural Resources and Environment to complete documents and procedures to submit to the National Assembly for promulgation of a Resolution on decentralization of the issuance of plans to implement the Provincial Planning.
On the morning of May 9, at the Government headquarters, Deputy Prime Minister Tran Hong Ha chaired a meeting with a number of ministries, branches and localities on the draft Resolution submitted to the National Assembly allowing the implementation of the 2024 Land Law on July 1, 2024 (earlier than the law's provisions from January 1, 2025) and a number of other important mechanisms and policies related to land.
At the meeting, Deputy Prime Minister Tran Hong Ha emphasized the development of draft resolutions of the National Assembly (on the pilot separation of compensation, support, resettlement, and site clearance into independent projects; decentralization of the issuance of plans to implement the Provincial Planning) to deploy new, breakthrough mechanisms and policies on land; resolve "hot" issues in practice of localities and enterprises in the spirit of "decentralization and delegation of power coupled with control, supervision, and ensuring conditions for implementation."
Emphasizing the importance of site clearance in implementing investment projects, the Deputy Prime Minister requested localities to propose a specific list of group B and C projects according to criteria or projects that need to separate site clearance work to include in the pilot resolution; at the same time, they are responsible for ensuring capital sources to organize implementation according to the set schedule.
In addition, the Deputy Prime Minister assigned the Ministry of Planning and Investment to preside over and coordinate with the Ministry of Natural Resources and Environment to receive and complete documents and procedures to submit to the National Assembly for promulgation of a Resolution on decentralization of the issuance of plans to implement the Provincial Planning.
Commenting on the pilot implementation of commercial housing projects through agreements on receiving land use rights or having land use rights that are not residential land, the Deputy Prime Minister said that the scope of implementation is land belonging to commercial, service, and production establishments in urban areas that must be relocated due to pollution, traffic congestion, etc. in accordance with land use and construction planning. Enterprises implementing commercial housing projects must have sufficient capacity according to the provisions of law.
Previously, reporting at the meeting, Deputy Minister of Planning and Investment Tran Quoc Phuong said that up to now, the draft Resolution submitted to the National Assembly to implement the 2024 Land Law on July 1, 2024; the draft Resolution on decentralization of the issuance of the plan to implement the Provincial Planning is being urgently received and the dossier is being completed in accordance with the set order, procedures and progress.
Regarding the draft Resolution on piloting the separation of compensation, support, resettlement, and site clearance into independent projects, Deputy Minister Tran Quoc Phuong said that the subjects of implementation are public investment projects in groups B and C that are currently stuck and selected and proposed by ministries, branches, and localities.
Regarding this issue, leaders of Bac Ninh, Hai Phong, Long An provinces... said that if land clearance work is separated into independent projects in some transport projects, it will help localities shorten preparation and implementation time and reduce land speculation.
Regarding the draft Resolution on piloting the implementation of commercial housing projects through agreements on receiving land use rights or having land use rights that are not residential land, Deputy Minister of Natural Resources and Environment Le Minh Ngan said that this policy aims to remove obstacles for projects using land for production, business, trade, services, etc. that have had their land use planning adjusted by the State to residential land; at the same time, it is proposed to prioritize pilot implementation for urban areas and urban development planning areas that have been approved.
Representatives of localities proposed to review and strictly regulate the ratio of pilot projects and commercial housing areas over the total area of housing project development needs approved by the housing development program and plan until 2030; and have a specific list of projects.
