Enforced transfer of land use rights at No. 12C Tam Giang (Hai Duong City)

On April 24, the Civil Judgment Enforcement Department of Hai Duong province organized the enforcement of the transfer of land use rights and the return of house number 12C Tam Giang (formerly number 12B Tam Giang), Tran Hung Dao ward (Hai Duong city) to enforce the judgment.

The Provincial Judgment Enforcement Department organized the enforcement of land use rights and house return to the judgment debtors, Mr. Nguyen Van T. and Ms. Nguyen Thi Thanh T.

The property subject to enforcement is house number 12C Tam Giang, Tran Hung Dao ward (Hai Duong city). The house was enforced to be handed over to Mr. Vu Quoc D. and Ms. Nguyen Thi Minh T. in Pham Ngu Lao ward (Hai Duong city).

The enforcement is carried out according to the civil judgment dated July 18, 2022 of the People's Court of Hai Duong province on "Dispute over house lease contract, request for return of land and termination of illegal occupation of land and houses; cancellation of land use right transfer contracts, authorization contracts, house lease contracts".

According to the verdict, Mr. D. and Ms. T. knew that Ms. Nguyen Thi Thanh N. and Mr. Tran Trong H. wanted to transfer the house and land at plot number 107, map sheet number 8, area 73.7 m2 at 12B Tam Giang street (now 12C Tam Giang), Tran Hung Dao ward.

The two parties signed a contract for the transfer of land use rights and assets attached to the land, which was notarized at Thanh Do Notary Office. The contract stated the value as 300 million VND, but the actual transaction amount between the two parties was 2.25 billion VND. After that, Mr. D. and his wife paid taxes and fees in full.

On April 10, 2018, the Hai Duong City Land Use Rights Registration Office recorded the changes in the monitoring book and confirmed that Mr. D. and his wife were the land users and owners of the property attached to the above land plot. Because Ms. N. (the seller) wanted to re-rent the house and land, the two parties signed a 5-month lease contract notarized at Thanh Dong Notary Office.

When the contract expired, Mr. D. and his wife came to get the house back but did not know when Ms. N. and Mr. H. (who sold and rented the house) had moved elsewhere. Mr. T. is Ms. N.'s biological father and is directly managing and using the house. Mr. D. and his wife asked for it back many times but Mr. T. did not return it.

The provincial Civil Judgment Enforcement Department has decided to enforce the transfer of land use rights and return the house to Mr. D and his wife. The enforcement work was carried out as required, ensuring compliance with regulations and safety.
