The project of the residential area (KDC) for commercial services north of Phu Thu town (now ward) (abbreviated as Phu Thu KDC project), Kinh Mon town, was approved by the Provincial People's Committee for detailed planning 1/500 since 2014. The project is being implemented but there is an overlap in land area in the planning.
The investor implementing the project is the joint venture of Tan Cuong-Viet Bac-Binh Minh Company. The project has a total area of nearly 73 hectares with a planned population of about 6,000 people. According to the approved detailed planning, the project has more than 21.4 hectares of residential land, more than 13.2 hectares of green land, water surface, sports land, nearly 5.3 hectares of commercial service land, the rest is technical infrastructure land, traffic land, parking lot...
The project is divided into 2 phases, phase 1 is more than 37 hectares wide, the remaining area is implemented in phase 2. According to the first divergence schedule, phase 1 is expected to be completed in the third quarter of 2018; phase 2 will be completed in the fourth quarter of 2020. However, in the process of implementing the procedures to implement the project, there are many difficulties such as problems in changing the land use purpose, the land clearance of Hai Duong Mineral Exploitation and Processing Joint Stock Company is delayed... leading to prolonged compensation and site clearance.
It was not until November 2017 that the People's Committee of Kinh Mon town approved the compensation and support plan for the first phase of the project. In addition, the procedures for connecting the project to National Highway 17 and the environmental impact assessment of the project must be approved and assessed by central ministries and branches, so the procedures are lengthy and slow. The project has been extended by the province to complete phase 1 before May 2023 and phase 2 before June 2025. In May 2020, the Provincial People's Committee decided to change the land use purpose of more than 23.3 hectares that had been recovered, cleared and handed over to the investor to implement the project.
During the project implementation, the investor discovered an area overlap. Specifically, the area on National Highway 17 has a factory building overlapping the planned land area. In early January 2022, the Provincial People's Committee assigned the Department of Natural Resources and Environment to preside over and coordinate with relevant units to inspect, verify and clarify.
The construction unit is implementing infrastructure construction on the land area that has been handed over.
The Department of Natural Resources and Environment has coordinated an inspection and found that there is an overlap in the Phu Thu Residential Area project. In the project planning, the Kinh Mon Town People's Committee leased land to Nguyen Van Manh's business household on June 30, 2014 to implement a project to invest in a business facility for construction materials, agricultural supplies, and repair and sale of cars and motorbikes. Because the 2013 Land Law took effect from July 1, 2014, the decision to lease land by the Kinh Mon Town People's Committee was not implemented in practice. The Town People's Committee re-implemented the process. In November 2017, the Town decided to lease nearly 4,000 m2 of land to Nguyen Van Manh's business household for a term of 25 years. Currently, this business household has invested in building a factory, conducting production and business activities, but has no construction procedures or environmental protection procedures. The current leased land area is about 2,000m2, belonging to phase 1 planning of Phu Thu residential area project, the remaining area belongs to phase 2 planning.
On February 17, 2022, the Provincial People's Committee directed the Kinh Mon Town People's Committee to inspect and review the land lease to Mr. Manh's household as a basis for resolving the problem. Urgently find solutions to soon hand over the land to the investor to implement the project. The Provincial People's Committee also requested the town to inspect, clarify, and handle violations of construction, environmental protection, and investment (if any) for Mr. Manh's household. At the same time, consider, clarify, and handle the responsibility of relevant collectives and individuals due to shortcomings in consulting and deciding to lease land to Mr. Manh's household. The Provincial People's Committee requested Kinh Mon Town to report the settlement results before March 15, 2022.
According to Mr. Truong Duc San, Chairman of Kinh Mon Town People's Committee, the town has urged specialized agencies to inspect, review and implement the province's instructions. The town is considering reclaiming the overlapping leased land area.
