How to transfer motorbike license plate without previous owner

According to Circular 24/2023 of the Ministry of Public Security, effective from August 2023, car and motorbike license plates are issued and managed according to the vehicle owner's identification code, also known as the identification plate. People who are using a vehicle that is not the owner will be fined if they do not complete the name change procedure.

In fact, many vehicle owners are using vehicles that are not registered to them, and do not even know where the previous owner is. Therefore, the circular devotes Article 31 to regulating the issuance and revocation of registration and license plates for motor vehicles. Accordingly, people can transfer the ownership of their vehicles without the previous owner, similar to the steps in the procedure for "transferring ownership of vehicles that have been transferred to many organizations and individuals".

The specific steps are as follows:

Step 1:Carry out withdrawal procedures

The person using the vehicle goes to the agency that is managing the vehicle registration file to complete the revocation procedure. Then, declare the revocation declaration, vehicle registration number on the public service portal, then provide the online file code and submit the paper file with the vehicle registration number and vehicle registration.

After confirming the valid documents, the vehicle registration authority issues a certificate of revocation of registration and license plate. In case the agency managing the documents and the agency registering the vehicle transfer are the same, the person using the vehicle does not have to carry out the revocation procedure, instead, he/she only needs to submit the vehicle registration certificate and license plate when carrying out the transfer procedure.

Step 2:Procedures for transferring motorbike ownership without the previous owner

The person using the vehicle must complete the vehicle registration transfer procedure at the vehicle registration office where he/she is permanently or temporarily residing.

Vehicle transfer documents include vehicle registration declaration (clearly stating the purchase and sale process and commitment, taking responsibility for the legal origin of the vehicle), registration fee documents, registration revocation certificate, vehicle license plate (with a copy of the engine number and chassis number with the seal of the vehicle registration agency).

Step 3:Those who wish to transfer the vehicle title will receive an appointment letter within 30 days. During this time, the authorities will verify the vehicle registration data.

Step 4:After the police complete the verification procedures, if there is no dispute, the people will receive the vehicle registration result.

According to Decree 10/2022/ND-CP, motorbikes paying registration fees for the second time or more will be subject to a fee rate of 1%. The price for calculating the registration fee is the value of the new asset multiplied by the remaining quality percentage.

Regarding the fee for issuing and changing vehicle registration and license plates, Circular 60/2023/TT-BTC stipulates: Issuing and changing the registration certificate with the license plate is 100,000 VND, issuing and changing the license plate alone is 50,000 VND.
