The Government has just issued Decree No. 69/2023/ND-CP amending and supplementing a number of articles of Decree No. 159/2020/ND-CP dated December 31, 2020 on the management of title holders, positions and representatives of state capital in enterprises.
Decree No. 69/2023/ND-CP amends and supplements Article 28 of Decree No. 159/2020/ND-CP on conditions for appointing state-owned enterprise managers and controllers.
Accordingly, Decree No. 69/2023/ND-CP stipulates 9 conditions for appointing state-owned enterprise managers and controllers instead of 7 conditions as prescribed in Decree No. 159/2020/ND-CP.
9 conditions for appointing state-owned enterprise managers and controllers include:
Ensure general standards and conditions according to regulations of the Party and State and specific standards and conditions of appointed positions and titles according to regulations of competent authorities.
For personnel from local sources, they must be planned for the appointed position or title or be planned for an equivalent position or title or higher. For personnel from other sources, they must be planned for an equivalent position or title or higher. Special cases will be considered and decided by competent authorities.
In case a newly established enterprise has not yet approved the planning, the competent authority shall consider and decide.
Have personal records, resume, asset and income declaration as prescribed.
Regarding the age of appointment, Decree No. 69/2023/ND-CP stipulates that personnel proposed for the first time to hold a leadership or management position or proposed to hold a higher leadership or management position must be of age to work for the entire term of appointment. The time for calculating the age of appointment is implemented according to the regulations of the competent authority.
Special cases shall be considered and decided by competent authorities. Personnel transferred or appointed to a new position equivalent to or lower than the current position shall not be considered for appointment age according to the provisions in Point a.
Be healthy enough to complete the assigned tasks.
Not in cases prohibited from holding positions according to the provisions of law.
Not under disciplinary action, investigation, prosecution or trial. In case the enterprise is under inspection or examination by a competent authority, the competent authority shall discuss with the inspection or examination agency about the proposed personnel before making a decision.
Have held the current position or equivalent position for at least 2 years (24 months), if not consecutive, it can be accumulated (only accumulated for the time held in equivalent positions). Special cases will be considered and decided by the competent authority.
A business manager who is disciplined during his/her term of office shall not be appointed or recommended for candidacy to a higher position within the time limit prescribed by the competent authority.
