According to the investigation conclusion, Mr. Tran Van Minh had enough signs of bribery but died before working with the investigation agency, so criminal responsibility was not considered.
According to the investigation conclusion in the Saigon Dai Ninh case, Mr. Tran Van Minh, former Deputy Inspector General of the Government (deceased) was accused of receiving 10 billion VND from tycoon Nguyen Cao Tri, Vice Chairman of the Ho Chi Minh City Real Estate Association, General Director of Saigon Dai Ninh Company.
Defendant Nguyen Cao Tri stated that he had a close relationship with Mr. Tran Van Minh because he was in the same graduate school class. Knowing that Mr. Minh was the one who signed the inspection conclusion recommending the withdrawal of the Dai Ninh project, Tri met Mr. Minh to discuss his desire to buy back the project and asked Mr. Minh to consider extending the project.
Mr. Minh agreed to help Tri and instructed Tri to submit a petition of Saigon Dai Ninh Company to the Government leaders so that the Government Inspectorate has a basis for resolution. Minh clearly told Tri that "if I can sign the petition to withdraw, I will be able to sign the extension of the project", so Tri trusted and felt secure to sign the contract to buy back the project and shares of Saigon Dai Ninh Company from Ms. Phan Thi Hoa.
During the process of submitting the petition, Tri was instructed by Mr. Minh to ask the Government leader to consult with Mr. Mai Tien Dung, Minister, Head of the Government Office, to ask for the direction of the Permanent Deputy Prime Minister to assign the Government Inspectorate to consider and resolve, creating "weight" for Mr. Minh to propose establishing a Working Group to verify the petition and recommend extending the project. Mr. Minh informed Tri that he had directed Le Quoc Khanh, Head of the petition verification team, to support Tri in extending the project and gave Khanh's phone number for Tri to contact for work.
In addition, with his relationship, Tri also contacted and sent a petition to Saigon Dai Ninh Company to influence, change the business registration, change the legal representative from Ms. Phan Thi Hoa to Tri; worked with the Working Group and Lam Dong province to reach consensus, propose to amend the inspection conclusion from revoking the project, terminating the project investment activities to not revoking for extension, delaying the progress of Dai Ninh project.
At the same time, speeding up procedures after the inspection conclusion to transfer the Dai Ninh project with a value of VND 27,600 billion, has earned a profit of VND 2,700 billion from Thien Vuong Real Estate Investment and Development Company Limited, a member of Novaland Group.
During the process of applying for these procedures, Nguyen Cao Tri contacted and gave money to individuals at the Government Inspectorate and Lam Dong province to help Tri avoid having his project revoked and get an extension against the law.
In which, Tri made an appointment to meet Mr. Tran Van Minh and gave Mr. Minh 8 billion VND at Mr. Minh's private house (District 3, Ho Chi Minh City). Three days later, Tri continued to give Mr. Minh 2 billion VND through Mr. Minh's son in the area near his private house.
"Mr. Tran Van Minh's behavior has all the signs of the crime of accepting bribes, as stipulated in Clause 4, Article 354 of the Penal Code. However, because Mr. Tran Van Minh died before working with the Investigation Agency, criminal responsibility should not be considered," the investigation conclusion stated.
Working with the investigation agency, Mr. Minh's wife and son stated that they did not know about the relationship and agreement to give money between Tri and Mr. Minh; did not participate in the discussion, agreement, or use of the 10 billion VND that Tri gave to Mr. Minh and are currently unable to return that amount.
The Ministry of Public Security's Investigation Police Agency has issued documents requesting to prevent transactions of three real estate properties under the names of Mr. Tran Van Minh and his wife and son to ensure the resolution of the case.
