Everyone needs to be vigilant, verify information and legal conditions carefully or they won't be able to claim their deposit because they bought land without a "red book".
At the end of 2022, Mr. N.D.T. signed a contract and deposited over 500 million VND with Mr. MVN, also in Nam Sach district (Hai Duong) to buy a plot of land in the locality that Mr. N. introduced himself as the owner of the plot. The two parties transacted with each other mainly based on trust and the plot of land did not have a red book (land use rights certificate).
Later, Mr. T. saw another person selling the land and realized that Mr. N. was not the owner of the land but only a broker. Discovering Mr. N.'s fraudulent behavior, Mr. T. asked Mr. N. to return his deposit. Mr. N. admitted to falsifying information that he was the owner of the land but has only returned Mr. T. 100 million VND.
Mr. T. filed a complaint with the Nam Sach District Police and was informed that the incident was a violation of civil transactions. According to regulations, if Mr. T. wants to reclaim the deposit, he must submit a petition to the court for settlement. Currently, Mr. N. does not have the financial capacity to return the above amount, so it will be very difficult and complicated for Mr. T. to reclaim the deposit.
From this incident, everyone needs to be vigilant, carefully verify information and legal conditions when trading real estate to avoid disputes and property damage.
