With many important new points, the 2022 Inspection Law is expected to overcome the limitations and difficulties in the provisions of the previous Inspection Law.

Many new points

The 2022 Law on Inspection, effective from July 1, 2023, consists of 8 chapters and 118 articles, an increase of 1 chapter and 40 articles compared to the 2010 Law on Inspection. The Law has many notable new points such as: General departments and departments under ministries are allowed to establish specialized inspection agencies; Provincial People's Committees have the right to establish departmental inspectorates; clearly stipulate the time for issuing inspection conclusions; there must be coordination in inspection, state audit, and investigation activities; there is no longer a people's inspection regime...

Some new points of the 2022 Inspection Law will overcome previous difficulties. Specifically, according to Clause 1, Article 78 of the 2022 Inspection Law, within 15 days from the date of receiving the draft inspection conclusion, the person issuing the inspection decision shall sign and issue the inspection conclusion and be responsible for his/her conclusions and recommendations. “The 2010 Law does not have specific regulations on the time limit for issuing inspection conclusions, but only states the deadline for publicizing inspection conclusions within 10 days. Clearly stipulating the time limit for issuing conclusions will overcome the situation of shirking responsibility, avoiding responsibility, and eliminating the situation of slow issuance of inspection conclusions, especially for surprise inspections,” said Mr. Tran Xuan Thuan, Chief Inspector of Ninh Giang District.

Chapter VI of the 2022 Law on Inspection also stipulates coordination in inspection, state audit, and investigation activities. This will promote the results that the Hai Duong provincial inspection sector has achieved over many years. Every year, in early July, the provincial Inspectorate guides and orients the development of inspection plans for departments, branches, and localities to review and discuss to handle and avoid overlapping in inspection and examination activities. Hai Duong does not allow enterprises to be inspected more than once a year, except in cases of surprise inspections when there are signs of violations by competent authorities.

On the afternoon of July 20, Thanh Ha District Inspectorate announced its decision to inspect the implementation of policies, laws, and tasks and powers of the People's Committee of Viet Hong Commune in the management and implementation of planning and agricultural land use plans. According to Thanh Ha District Inspectorate Chief Pham Huy Mo, this could be the last inspection in which the unit applies a number of provisions under the 2010 Inspection Law. From August 15, when Decree No. 43/2023/ND-CP of the Government detailing a number of provisions and measures for implementing the Inspection Law comes into effect, Thanh Ha District Inspectorate will implement and apply the provisions under the 2022 Inspection Law.

Another important point of the 2022 Inspection Law is that in addition to the operating budget, inspection agencies are allowed to deduct a portion of the recovered money discovered through inspection after being submitted to the state budget according to regulations to support the improvement of inspection activities. Thanh Ha District Inspector Pham Huy Mo proposed that it is necessary to reasonably allocate deductions from the recovered money at the provincial level to the district level to have a mechanism and funding to invest in modernizing inspection activities in the direction of applying information technology.

In order to contribute to quickly bringing the 2022 Inspection Law into life, promoting its effectiveness and efficiency, the Provincial People's Committee has issued Plan No. 2402/KH-UBND dated July 6, 2023 to implement the 2022 Inspection Law. According to the Provincial Inspectorate, it is expected that in the third quarter, propaganda and dissemination activities of the 2022 Inspection Law will be organized in many diverse and rich forms to agencies, units, organizations and individuals in the province. The Provincial Inspectorate will also direct and guide inspection agencies to organize for the staff and civil servants of the entire inspection sector to study and grasp the new provisions of the 2022 Inspection Law to apply them properly and effectively in the sector's operations.
