Enterprises use "golden" land for the wrong purpose

Located in a prime location in Hai Duong City, thousands of square meters of land managed by Hai Duong Export Trading Joint Stock Company and Hai Duong Pharmaceutical and Medical Supplies Joint Stock Company are being misused, causing waste.


The headquarters of Hai Duong Export Trading Joint Stock Company is seriously degraded, most of the area has been leased out.

Located on the main roads of Binh Han Ward (Hai Duong City), the land of Hai Duong Export Trading Joint Stock Company and Hai Duong Pharmaceutical and Medical Supplies Joint Stock Company has not been used effectively. These enterprises even used the land for purposes other than those stated in the land use right certificates.

Sublease premises

In 2002, Hai Duong Export Trading Joint Stock Company was equitized. After equitization, the company used more than 5,700 m2 of residential land in lane 265 Dien Bien Phu street, Binh Han ward (Hai Duong city). In 2009, the company was granted a land use right certificate by the Provincial People's Committee for a period of 25 years. The purpose of using the land was to build a headquarters and production and business facility. However, in reality, for many years, this company has had almost no production and business activities here. The company's headquarters is now seriously degraded and very shabby. Most of the area of ​​the land has been contracted by the company to other units to rent warehouses for storing items such as veterinary medicine, pesticides, electric cables and building temporary sheds for renting car parking spaces...

After being equitized in 2003, Hai Duong Pharmaceutical and Medical Supplies Joint Stock Company managed and used many plots of land in districts, cities and towns in the province. Of which, there were nearly 5,000 m2 on Dien Bien Phu Street and An Thai Street, Binh Han Ward. The company was signed a contract by the Provincial People's Committee to lease this area for a period of 25 years from March 2005, with annual land rental payments. In 2009, the Provincial People's Committee granted a land use right certificate to the company for the purpose of using it as a business store and warehouse for medical supplies. On the area leased by the province, most of the works were built by the company according to the licensed master plan. However, at the construction site of project No. 7 (transportation office), the company built a 1-storey steel frame structure with an area of ​​over 300 m2 without a construction permit. Most of the premises adjacent to Dien Bien Phu and An Thai streets have been leased by the enterprise to other units to trade in various products.

Through the reporter's investigation, since 2019, the Department of Natural Resources and Environment has inspected and reviewed the compliance with land laws for more than 40 state-owned enterprises and post-equitization state-owned enterprises, including Hai Duong Pharmaceutical and Medical Supplies Joint Stock Company. The Department of Natural Resources and Environment has pointed out violations in leasing premises and assets attached to land that are not in accordance with the production and business plan, and not in accordance with the content of the decision approving the equitization plan at a number of land plots used by Hai Duong Pharmaceutical and Medical Supplies Joint Stock Company. The Department has requested the enterprise to immediately stop leasing premises and assets on land that are not in accordance with the approved equitization plan. Any cases of changes in activities compared to the approved equitization plan can only be implemented after the company has reported and received written approval from the Provincial People's Committee. However, up to now, the re-leasing of premises continues.


Most of the land adjacent to Dien Bien Phu Street and An Thai Street has been leased by Hai Duong Pharmaceutical and Medical Supplies Joint Stock Company.

Ineffective

The land plots of Hai Duong Pharmaceutical and Medical Supplies Joint Stock Company and Hai Duong Export Trading Joint Stock Company are both adjacent to major roads, with bustling business, but the land use is not as effective as expected. The main activity on these plots is to sublease business premises.

According to the assessment of Hai Duong City People's Committee, the above two enterprises still fulfill their financial obligations regarding land rent and non-agricultural land tax, and do not owe the state budget as declared. However, the business results of Hai Duong Export Trading Joint Stock Company are not effective compared to the area and location of the leased land. Every year, the company pays insignificant VAT and corporate income tax. Meanwhile, Hai Duong Pharmaceutical and Medical Supplies Joint Stock Company organizes its warehouse in a densely populated residential area with high traffic density while An Thai Street has a small width, which greatly affects traffic safety.

According to Mr. Dang Vu Son, Secretary of the Party Committee of Binh Han Ward, the ward currently has many projects that do not meet the requirements but there is no suitable land fund for investment in construction or expansion. Especially the shortcomings related to the school system in the area.

According to the reporter's investigation, the cluster of secondary schools, primary schools and kindergartens in Binh Han ward has a total area of ​​about 6,010m2. The number of students in all 3 schools is over 2,100. The school is located in a short alley, so every day when parents pick up and drop off their children, the surrounding area often experiences serious traffic jams. In addition, the ward's kindergarten was established in 1985, the campus is small, only over 900m2 and there is no playground for children. The number of students is large but the kindergarten only has one small, steep, and quite dangerous staircase. Binh Han Secondary School also lacks a multi-purpose building because the school area is not enough to build. According to local calculations, by 2025, when the number of students increases, the current facilities of the schools will not meet the needs of teaching and learning.

Faced with this reality, the provincial authorities need to inspect the land use of the two enterprises at the above locations, and at the same time evaluate the effectiveness of land use; consider reclaiming the land area used for the wrong purpose, ineffectively to hand over to the locality to build public and welfare works.
