Mr. D. gave her the original documents to broker the sale of land, but Xinh mortgaged them to someone else to borrow 8 billion VND and spent it all.
On December 26, the People's Court of Da Nang City sentenced Nguyen Lam Xinh (38 years old, residing in Nai Hien Dong ward, Son Tra district, Da Nang city) to 18 years in prison for the crime of "Fraudulent appropriation of property".
Nguyen Lam Xinh has been a freelance real estate broker in Da Nang City since 2018. During her work, Xinh met Mr. Ly Tram Anh D. (41 years old, residing in Man Thai ward, Son Tra district).
In March 2019, Xinh brokered for Mr. D. to buy a plot of land with an area of 100.8 square meters in An Cu 2 Residential Area, Phuoc My Ward, Son Tra District from Mr. Nguyen Ngoc Th. (42 years old, residing in Bo Trach District, Quang Binh Province) for 14.5 billion VND.
After completing the payment procedure and receiving the full transfer fee, Mr. Th. handed over the original land use rights certificate to Mr. D.

In November 2019, someone contacted Xinh saying they needed to buy back this plot of land, so Mr. D. gave the red book to Xinh to trade, but then could not sell it.
Holding Mr. D's red book, Xinh mortgaged it to Mr. V. (residing in Thanh Khe district, Da Nang) to borrow a total of 8 billion VND. When she was unable to repay the debt, Xinh completed the procedures to transfer the land plot to Mr. V.
On September 4, 2020, Mr. V. built a house on this plot of land and Mr. D. discovered it, a dispute arose and the police investigated.
At the police station and at the trial, Xinh confessed to the whole incident and said that the money she had swindled and appropriated had been spent.
Nguyen Lam Xinh was sentenced to 7 years in prison by the People's Court of Da Nang City for "Fraudulent appropriation of property" in 2013. His criminal record has not been cleared, so he must bear the aggravating circumstances of criminal liability.
After 1 day of trial and 3 days of deliberation, the jury sentenced Nguyen Lam Xinh to 18 years in prison for "Fraudulent appropriation of property".
