At the regular meeting of May, the third time on the morning of May 23, after listening to the Department of Natural Resources and Environment report on the authorization for the district-level People's Committee to calculate specific land prices according to Resolution No. 73/NQ-CP dated May 6, 2023 of the Government, the Standing Vice Chairman of the Provincial People's Committee Luu Van Ban assigned the Department of Natural Resources and Environment to preside over and guide issues related to land price calculation. Localities urgently establish apparatuses, closely follow the instructions of the Department of Natural Resources and Environment to implement land price calculation. During the implementation process, relevant departments and branches regularly inspect, guide, urge and supervise the implementation process in localities. The calculation of land prices by provincial and district-level councils in the same locality needs to be closely coordinated to ensure fairness in the same locality, avoiding complaints. During the implementation process in localities, if there are any difficulties or problems, they need to be summarized and reported to the Provincial People's Committee for timely direction and resolution.
On May 22, the Provincial People's Committee decided to authorize the District People's Committee to decide on specific land prices to calculate compensation when the State reclaims land, collect land use fees when allocating land for resettlement; calculate land use fees, land rent when the State allocates land, leases land, changes land use purposes to households and individuals; determine land prices for areas exceeding the limit when the State recognizes residential land use rights for households and individuals; determine starting prices for auctioning land use rights for households and individuals.
Director of the Department of Natural Resources and Environment Hoang Van Thuc spoke about the issue of authorizing land price calculation to the district People's Committee at the meeting.
The District People's Committee decides to establish a Land Valuation Council. Members of the Land Valuation Council include: Chairman of the District People's Committee as Chairman of the Council and leaders of the district-level financial agency as standing members of the Council; leaders of the natural resources and environment agency, relevant district-level professional agencies and leaders of the People's Committee of the commune where the land is located; organizations with the function of consulting on land valuation or land price experts and other members decided by the District People's Committee. The District Department of Natural Resources and Environment assists the District People's Committee in organizing land valuation.
The term of authorization is from the date of signing and promulgation until the 2013 Land Law expires. The District People's Committee is responsible for properly implementing the contents and scope of authorization; is responsible before the law, the Provincial People's Committee and the Chairman of the Provincial People's Committee for the results of performing the authorized tasks. Periodically every quarter, every year or suddenly according to the requirements of the general tasks, the District People's Committee reports to the Provincial People's Committee, and at the same time sends to the Department of Natural Resources and Environment, Department of Finance on the results and implementation status of the authorized contents...
