A New Mexico state judge has upheld the decision to prosecute actor Alec Baldwin for shooting and killing a co-star on the set of "Rust" in 2021.
According to People, the actor still has to attend the trial in July, facing the risk of receiving an 18-month prison sentence if convicted. Baldwin's legal team said they accept the new verdict and are waiting for the trial date.
In March, Alec Baldwin's side filed a motion to dismiss the "manslaughter" case, arguing that prosecutor Kari T. Morriessey, who handled the case, was "prejudiced" in her arguments asking the jury to indict the actor.
In April, prosecutors cited witness testimony that Alec Baldwin "frequently yelled and swore" on set. Employees described the actor as a man who "did not know how to control his emotions" and did not care how his behavior affected those around him.
In response to the character claims, Baldwin's attorneys argued that their client was being defamed. They called the prosecution's 32-page document a "statement against Baldwin and the defense."
In response to the back-and-forth, Judge Sommer held a hearing on May 17 to hear arguments from both sides. While the presiding judge could have ruled on the court documents alone, the hearing was necessary to allow the jury to hear from the lawyers, according to legal expert Emily D. Baker.
