The revised Land Law recently passed by the National Assembly stipulates that land of households and individuals without documents before July 1, 2014, without disputes and without violations of land laws, will be granted red books.

After four sessions for comments, on the morning of January 18, the Land Law (amended) was voted on by the National Assembly and will take effect from January 1, 2025 (except for some specific provisions).

The revised Land Law recently passed by the National Assembly details cases where households and individuals using land without documents will be granted land use right certificates.

The revised Land Law, recently passed by the National Assembly, stipulates that land of households and individuals without documents before July 1, 2014, without disputes and without violations of land laws, will be granted red books.

Accordingly, the granting of specific land use right certificates to households and individuals using land without documents is based on different land use time frames.

The law divides groups of cases that are granted land use right certificates for land without documents, including:

Firstly, households and individuals using land before December 18, 1980, are now confirmed by the People's Committee of the commune where the land is located to have no disputes.

Second, households and individuals using land from December 18, 1980 to before October 15, 1993, are now confirmed by the People's Committee of the commune where the land is located to have no disputes.

Third, households and individuals using land from October 15, 1993 to before July 1, 2014, are now confirmed by the People's Committee of the commune where the land is located to have no disputes.

In the above cases, specific regulations on granting land use right certificates will be implemented differently.

In addition, the law also stipulates that households and individuals who are eligible to be allocated agricultural land as prescribed in Clause 1, Article 118 of this law and have used residential land or non-agricultural land before July 1, 2024 without the prescribed documents, have registered permanent residence in a locality in an area with difficult socio-economic conditions or an area with particularly difficult socio-economic conditions, and are now confirmed by the People's Committee of the commune where the land is located that there is no dispute, will be granted a certificate of land use rights and ownership of assets attached to the land and will not have to pay land use fees.

In addition, households and individuals who are using land stably for agricultural purposes and are now confirmed by the People's Committee of the commune where the land is located to have no disputes will be granted a certificate of land use rights and ownership of assets attached to the land in the form of the State allocating land without collecting land use fees for the area of ​​land currently in use but not exceeding the prescribed limit of agricultural land allocation to individuals. The land use term is calculated from the date of issuance of the certificate of land use rights and ownership of assets attached to the land. The remaining agricultural land area (if any) must be converted to State land lease.

More detailed regulations on granting land use right certificates for land without documents will be stipulated by the Government in a decree guiding the implementation of the law.
