The case of the biological mother's "fake husband" abusing a 3-month-old baby to death in Ba Ria - Vung Tau has caused public outrage in recent days. On the evening of August 18, the Investigation Police Department of Ba Ria - Vung Tau Province Police initiated a murder case, prosecuted the accused, and temporarily detained Nguyen Minh Phung (19 years old, residing in Long Dien District, Ba Ria - Vung Tau) to investigate and clarify the act of "Murder".
Dr. and lawyer Dang Van Cuong - Executive Committee member of the Vietnam Association for the Protection of Children's Rights - said that initial verification results from the investigation agency showed that the defendant hit the three-month-old baby in the head, leading to the victim's death.
Lawyer Dang Van Cuong said the perpetrator will face strict penalties according to the provisions of Clause 1, Article 123 of the Penal Code.
Defendant Nguyen Minh Phung is of legal age and is fully aware that his actions could cause death, but he still intentionally committed them, so the investigation agency's prosecution for murder under Article 123 of the Penal Code is well-founded and in accordance with the law.
"It can be seen that the defendant's actions were very cruel and inhumane, seriously violating children's rights and illegally depriving the life of a three-month-old baby. Therefore, considering and prosecuting Nguyen Minh Phung for murder is well-founded and very necessary for general deterrence and prevention for society," said lawyer Cuong.
According to lawyer Dang Van Cuong, the fact that Phung was willing to kill such a young child out of jealousy, selfishness, and disregard for the law shows that he was cold-blooded and a thug.
"With hooliganism and crimes against people under 16 years old, this subject will face the strict penalty prescribed in Clause 1, Article 123 of the Penal Code, which is imprisonment from 12 to 20 years, life imprisonment or death penalty," said lawyer Cuong.

According to lawyer Cuong, the investigation agency will clarify the cause and motive for the crime. At the same time, clarify the responsibility of the child's mother for this incident. When Phung committed the act of killing the child, did the child's mother know or did she prevent it? At the same time, clarify who caused the previous injuries.
In case there is evidence that the child's mother also committed an act that harmed the child's life or health, and had the same intention to commit the crime with this subject, she will also be prosecuted as an accomplice. In case the child's mother did not commit an act that harmed the child's life or health, and cannot prove that she had the same intention to commit the crime, she will not be prosecuted.
"This case will be a lesson for many young people who have a loose, easygoing lifestyle, give birth outside of marriage at a very young age, and have temporary lives, living as husband and wife while not ensuring economic conditions, having limited social awareness and not having enough skills to take care of children.
The price to pay for the child's murderer is very severe, possibly losing his life. However, the young mother in this case will also be tormented for the rest of her life," added lawyer Cuong.
This boy is the son of THBL (15 years old, permanent resident of Can Tho City). L. is living as husband and wife with Nguyen Minh Phung (19 years old) in group 8, Long Nguyen quarter, Long Dien town, Long Dien district.
Previously, on July 17, the boy was admitted to Children's Hospital 2 (Ho Chi Minh City). Here, through diagnosis, the boy had a subdural hemorrhage in the right cerebral hemisphere, a 1.3-meter open fracture in the middle of the left femur, multiple fractures, multiple scratches on the face and neck, severe pneumonia, sepsis, and severe malnutrition.
On July 31, the baby was discharged by his mother with a diagnosis of pneumonia, sepsis, multiple fractures, soft tissue injuries, and brain hemorrhage. On August 15, THBL and Phung had a conflict at Phung's house.
Because the baby kept crying, Phung used her hand to hit the baby's forehead hard. Then, Phung continued to squeeze the baby's face and shake it back and forth. Seeing that the victim had fainted, THBL and Phung took him to Ba Ria Hospital for emergency treatment.
Ba Ria Hospital determined the victim died before being taken to the hospital.
